TERMS OF SERVICE AGREEMENT

N-Site & Development LLC Effective Date: June 2026

These Terms of Service ("Terms") govern your use of the website located at https://services.nsitedev.com/ (the "Site") and any services requested through it, by phone, or in person, including excavation, grading, land clearing, demolition, trenching, compaction, filling, commercial site development, and dump truck hauling (collectively, the "Services"), provided by N-Site & Development LLC ("N-Site," "we," "us," or "our"). By using the Site or requesting a quote or Services from us, you agree to these Terms. If you do not agree, please do not use the Site or request Services.

1. Overview of Services

N-Site & Development LLC provides site work and earthwork services to homeowners, contractors, and developers. Services offered may include but are not limited to excavation, grading, land clearing, demolition, trenching, compaction, structural filling, commercial site development, and hauling of dirt, sand, gravel, or debris. The specific scope of work for any project will be defined in a separate written quote or contract, which is a distinct document from these Terms and governs the actual performance of work.

2. Quotes, Estimates, and Site Visits

Quotes provided over the phone are preliminary and based on the information you provide. For larger or more complex jobs, an on-site visit may be required before a written quote can be issued. Written, scope-of-work quotes are typically provided within 2 business days for standard jobs and 3 to 5 business days for site development projects, though timing may vary based on project complexity and scheduling.

All quotes are estimates based on the conditions known or visible at the time of the visit or call. Quotes are not final until confirmed in a signed written agreement. Underground utilities, unforeseen soil conditions, hidden debris, permitting issues, or other conditions discovered once work begins may result in a revised scope of work and updated pricing, which will be communicated to you before additional work proceeds.

3. Deposits, Payment, and Scheduling

Projects are scheduled once a written quote is signed and a deposit is received, as outlined in the applicable quote or contract. The remaining balance is due upon completion of the work unless otherwise agreed in writing. Specific deposit amounts, payment methods, and payment schedules will be set out in your individual project quote or contract, not in these Terms.

Failure to pay amounts owed on time may result in delays to your project, suspension of work, or other remedies available to us under the applicable contract and law.

4. Cancellations and Rescheduling

We understand that plans change. If you need to cancel or reschedule a confirmed project, please contact us as soon as possible. Deposits may be non-refundable or partially refundable depending on how much notice is given and whether materials, equipment, or crew time have already been committed to your project. Specific cancellation terms will be detailed in your written quote or contract.


5. Site Access and Client Responsibilities

To perform Services safely and efficiently, you agree to provide reasonable access to the project site and to disclose any known hazards, underground utilities, property lines, easements, or other relevant site conditions of which you are aware. You are responsible for obtaining any permits, surveys, or approvals required for your project unless we have specifically agreed in writing to handle these on your behalf.

We are not responsible for delays or additional costs caused by inaccurate information provided about the site, restricted access, or undisclosed conditions.

6. Locates and Underground Utilities

Where applicable, we will coordinate utility locate requests (such as 811 or equivalent services) prior to excavation or trenching work. However, utility marking services are not always fully accurate or complete, and private lines (such as irrigation, invisible fencing, or unmarked private utilities) may not be identified through standard locate requests. We are not liable for damage to utilities that were not properly marked, disclosed, or locatable through standard processes.

7. Insurance and Liability

N-Site & Development LLC carries insurance appropriate to the scope of our operations. Nothing in these Terms is intended to limit any liability that cannot be limited under applicable law. Except as otherwise stated in a signed project contract, we are not liable for indirect, incidental, or consequential damages arising from delays, weather conditions, subsurface conditions, or other circumstances outside our reasonable control.

8. Website Use

The content on this Site, including text, images, logos, and design elements, is the property of N-Site & Development LLC or its licensors and may not be copied, reproduced, or used without permission. The Site and the information on it are provided for general informational purposes and do not constitute a binding offer, contract, or guarantee of pricing, availability, or scheduling. Actual project terms are established only through a signed written quote or contract.

We make reasonable efforts to keep information on the Site accurate and current but do not guarantee that the Site will be free of errors, delays, or interruptions.

9. Communications

By submitting a request for a quote or contacting us through the Site, by phone, or by email, you consent to being contacted by N-Site & Development LLC regarding your inquiry, using the contact details you provide. You may opt out of non-essential communications at any time by contacting us directly.

10. Limitation of Liability

To the fullest extent permitted by law, N-Site & Development LLC's total liability for any claim arising from the Site or from Services performed shall not exceed the amount paid by you for the specific project giving rise to the claim, except where a separate signed contract provides otherwise.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles, unless otherwise specified in a signed project contract.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business or legal requirements. The effective date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
